TOS
General Client TOS
By placing a commission with me, you automatically agree to these Terms and will have to follow them. Failure in doing so will result in you being placed on my blacklist and blocked without warning. Understand that these Terms are in place to protect both myself and you when we work together, if you deem these Terms unfit please do not contact me and avoid working with me.
I.> Payment will be received either upfront or half upfront and half after the final product has been delivered. The upfront payment is expected at the latest after I have started with the sketch. You will be notified of this and payment is expected before you will be shown any work in progress images.
II.> You will not receive the rights to the product until I have received the full payment. If this is not provided, you will not get the rights to the product and will be blacklisted if you are caught claiming it as yours (i.e. showing it off somewhere, using it as your profile picture - this does not count for sharing WIP images with friends or in private spaces)
II.1.> Before full payment has been made, you will receive a watermarked version of the image unless I know you are a trustworthy person (i.e. if we are friends or I have worked with you before)
III.> I will under no circumstances allow anyone to use my artwork to train any form of AI, if you are caught doing so I will immediately blacklist and block you with no warning. Same goes for art theft, in which case legal action may be taken.
IV.> Refunds will only be issued after the initial sketch and before any further progress has been made. The reason for this refund is irrelevant, though unless it is because of an actual emergency I reserve myself the right to keep 20% of the money sent if the sketch has already been completed.
IV.1.> Chargebacks that are made without previous communication with me will get you blacklisted immediately.
V.> Changes may be requested when I send the sketch. You may change up to three small things (i.e. expression, colours, slight adjustments to pose), you will have to pay a small fee for extra changes. Big changes (i.e. changing the entire pose, character, a whole overhaul of the colours) is not permitted and will, in the worst case, lead to me rejecting your commission and you receiving a partial refund.
V.1.> Editing the artwork yourself is not permitted, unless previously discussed with me. Even in that case, only small changes may be made (i.e. a filter on the art)
V.2.> Cropping or editing out the signature is under no circumstances allowed!!
Client TOS - Artwork
I.> You, the client, have to credit me when showing my artwork anywhere, with explicit credit (i.e. "credit goes to @Nyxolotl on Twitter/Nyxolotl, they are in this server!")
II.> Commercial Rights to the artwork may be purchased, the intended use and your reach will affect the price in this case.
II.1.> Commercial use, in this case, is defined as anything that will bring you profit, i.e. as a thumbnail for a YouTube video or a profile picture on one of your social media accounts you use to advertise to your audience. This could also be the case if you use the artwork as an "eye-catcher" on your social media page to advertise your stream/video/etc. Please discuss this further with me if this is the intended use.
III.> You may not commission artwork for someone on my blacklist.
Client TOS - Designs
I.> You may use the design for any purpose as long as credit is given. When sharing the design in any space for the first time, explicit credit will need to be given. This only needs to be done the first time when sharing a design in that specific space, after that you are free to share them there with no credit needed. When sharing them in a new space, however, you will need to credit me again the first time you share them.
II.> Trading/Selling/Gifting any of my designs to anyone on my blacklist is not permitted.
III.> You may redesign any of my designs that belong to you to any degree, as much as you want as long as I am credited as the original designer.
IV.> If the design is used for NSFW content (specifically sexual in nature), please make sure to always censor it and to not tag me in the artwork or writing. I do not want to see it.
General Artist TOS
I.> I, the artist, reserve myself the right to refuse to work with you for any reason including no reason.
I.1.> This also means that I may refund you at any point during the commission process if I no longer wish to work with you.
II.> I will give up my rights to the artwork after full payment has been received. I do, however, keep the right to use the artwork as an example of my work or to show it online as far as no profit is made unless previously discussed with the client.
III.> Standard wait time is 3 months at most, if the commission is not completed or almost completed at that point you are eligible for a full refund. However, if I communicate to you that this time limit will be exceeded because of a personal situation/emergency that limit will be extended.
III.1.> This same policy goes for commissions that have to be done within a certain (short) time frame, though in this case a refund is the most likely option on my end.
III.2.> You may request the commission be done by a certain date, though if that time frame is short you will be required to pay extra to accommodate for my loss of personal time.
IV.> You have the right to ask for updates at any time and I will be required to provide one. This means that if there is no progress made, I will properly communicate this to you.
IV.1.> Please note that being super persistent and asking every day will make me less willing to work with you and may lead to me cancelling your commission in extreme cases.
